We at UpRival respect our visitors and clients. Our Privacy Policy is intended to inform you about what kind of information we collect, how we use it, with whom it may be shared, as well as the choices you have regarding our use of your information.

As an American headquartered company, the information UpRival collects will be processed in the U.S.

Privacy Practices for Our UpRival Website (www.uprival.com)

UpRival firmly believes in the importance of online privacy. We do not collect any information that enables us to determine your actual identity (“personal information”) before, during, or after your visit to our uprival.com website or our regional sites accessible from this website, other than personal information you voluntarily supply to us (e.g. by submitting information through the “Get Started” form or the “Request A Demo” form). When you provide personal information directly to us, this information is used by UpRival solely for the purposes identified at the point you provide it.

Registration

In order to use the Services, you must first complete the registration form, and choose a password. During registration, you must provide contact information, such as your name, phone number, company name, and website. We use this information to create your account, and to contact you in regards to the Services.

Orders

If you wish to fund your account, you must provide your address and financial information (e.g. credit card number; expiry date; etc). When payment, or payment information, is required, we will direct You to submit credit card information through a third-party such as Stripe. If we have trouble processing an order, we will use the information we collected to contact you.

We also use your information for the following purposes:

  1. To create new services, features or content. We may use any information you provide us (e.g. via email or through our ticketing system) to create and provide new services, features or content. For example, we may publish interesting observations from the surveys for informational or marketing purposes. When we do this, we will not personally identify you, unless we first receive your permission.
  2. To contact you about your service or account. We occasionally send you communications related to transactions (e.g. service related announcements, billing related matters, changes to our services or policies, welcome emails when you first register, etc). You can’t opt out of these communications, since they are necessary in order for us to effectively provide our services to you.
  3. To contact you for marketing purposes (if you opt-in on our registration page). We will only do this if you have given us your express permission to contact you for this purpose.
  4. To respond to legal requests and prevent harm. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.

Personally Identifiable Information

We share personally identifiable information (PII) with certain third parties, in order to provide you with the Services. For example, we use stripe, a credit card processing company to bill you for the Services, and share PII with them in order to do so. They do not retain, share, store, or use PII for any other purpose. Finally, we share PII with our parent company and subsidiaries, for record-keeping purposes, billing purposes, and for general business purposes.

We reserve the right to disclose your PII as required by law, and when we believe that disclosure is necessary to protect our rights and/or to comply with any applicable judicial proceeding, court order, or legal process.

Privacy Practices for Advertising and Content Served by UpRival

What Information Do We Collect and How Do We Use It?

We collect usage data about you whenever you interact with our Services. This may include which of our pages you visit, what you click on, when you performed those actions, and so on. Additionally, like most websites today, our web servers keep log files that record data each time a device accesses those servers. The log files contain data about the nature of each access, including originating IP addresses.

We collect data from the device and application you use to access our services, such as your IP address and browser type. We may also infer your geographic location based on your IP address. If you arrive at our website from an external source (such as a link on another website or in an email), we record information about the source that referred you to us.

We use third party tracking services that employ cookies and page tags (also known as web beacons) to collect aggregated and anonymized data about visitors to our websites. This data includes usage and user statistics, but not personally identifiable information.

We also use your information for the following purposes:

Through our services, our customers – advertisers, advertising agencies, publishers, and other users – may collect and use information about you to provide you a more enriched online experience. UpRival’s innovative tools and services are used to create advertisements, to deliver advertisements to websites and mobile applications on behalf of advertisers, to monitor the success of and manage advertising campaigns, and to present you with advertisements that are more likely to be interesting and relevant to you. To do this,

UpRival technology is deployed on third party websites and mobile applications to collect information that may be used for online ad tailoring purposes or to deliver an advertisement to you from a company whose website or mobile application you have visited or whose advertisement you have viewed in the past. UpRival’s technology employs cookies and similar technologies (pixels) to collect information about your browser or device, the advertisements served to it, interactions with those advertisements, and the approximate geographic location of the device’s internet service provider (“behavioral information”) in the course of providing our customers with ad-serving and campaign management services and for the purpose of helping our customers determine which advertisement is suitable to be delivered to you. This behavioral information, which does not enable UpRival to determine your actual identity, may be shared with our customers and UpRival’s and our customers’ partners for their lawful advertising purposes.

Do We Share Your Information?

We share aggregate information (non-personally identifiable information) about our users for marketing purposes. We also share aggregate information with third party providers, in order to provide the services (as noted above). We do not link aggregate user data with personally identifiable information.

Does UpRival use cookies?

Yes. “Cookies” are pieces of information (actually, alphanumeric identifiers) generated by web servers, and stored on your web browser for future access. Cookies cannot view or retrieve data from other cookies, nor can they capture files or data stored on your computer. We do not link the information that we store in cookies to any PII that you submit while on our site.

We use both session ID cookies and persistent cookies. We use session cookies to make it easier for you to navigate our site. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your web browser’s “help” file.

We set a persistent cookie to store your passwords, so you don’t have to enter it more than once. Persistent cookies also enable us to track and target the interests of our users to enhance the experience on our site.

If you reject cookies, you may still use our site, but your ability to use some areas of our site will be limited.

Want to stop seeing ads delivered through UpRival?

For all web ads, there is only one way to opt out of cookies: manually delete your cookies by following the instructions contained in the “Help” section of your browser (i.e. manually delete your cookies by clearing your cookie history in your browsers “Settings” tab). We will no longer deliver ads targeted to your preferences and usage patterns.

For all ads served in mobile apps, follow the instructions for your device type.

Does UpRival use web beacons (aka clear GIFs or web bugs)?

Yes. “Web beacons” are small images (generally a single transparent pixel) with a unique identifier, served to you as part of a web page or other document. Web beacons may be used in parts of our Services for purposes such as site traffic reporting, unique visitor counts, advertising auditing, and reporting.

Through our partners, we use web beacons in our HTML-based emails to let us know which emails recipients have opened. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns.

Your Privacy Rights

U.S. residents may direct us not to share their personal information with our affiliates and third parties for those parties’ own marketing purposes by sending an email to: [email protected]. Please include “Privacy” in the subject line.

Your Rights Under the GDPR

If You are a citizen or a resident of a country in the European Union, the GDPR grants You the following rights:

a. Access to Your Personal Data. You have the right to receive a copy of Your personal data that is subject to processing by UpRival. Ordinary requests will be granted without charge to You within one calendar month of when You make the request. In cases of excessive, unreasonable, or repeated requests UpRival may charge You a reasonable fee and may require additional time to grant Your request. Also, UpRival may use reasonable means to confirm Your identity before granting any request for data so as to prevent granting fraudulent requests. To request a copy of Your personal data, please contact us by e-mail at [email protected].

b. To have Your Data Corrected. If Your personal data is erroneous or outdated, You have the right to have it corrected. To do so, please contact UpRival via e-mail at [email protected], or simply log in to Your account at https://login.uprival.net/#/Users.

c. To be Forgotten. You have the right to be forgotten by UpRival. You may exercise this right by e-mailing us at [email protected]. We will comply with Your request, at no charge to You, within one calendar month by deleting Your account, along with all of Your personally-identifiable data that is subject to any UpRival processing. Naturally, after we grant Your request You will not have access to any UpRival products or services unless and until You open a new UpRival account. UpRival may use reasonable means to confirm Your identity before granting any request for data so as to prevent the granting of fraudulent requests.

d. To Restrict Processing of Your Data. You can request that Your data not be processed via UpRival partners. You can make that request by e-mailing us at [email protected] and, if you wish, you can even specify which third parties to restrict from processing Your data. We will respond to Your request, at no charge to You, within thirty (30) days from when You make Your request. Please be advised that some of our partners, e.g., Stripe, are essential to UpRivals services, so that if you block processing by them, UpRivals’ services may be unavailable to You.

e. Portability. You have the right to receive a copy of Your personal data that is subject to processing by UpRival in a portable format, or to have it transferred directly from UpRival to another party. Ordinary requests will be granted without charge to You within one calendar month of when You make the request. UpRival may use reasonable means to confirm Your identity before granting any request to transfer data to You or another party so as to prevent granting fraudulent requests. To request a copy of Your personal data in a portable format, or to request a direct transfer of Your data, please contact us by e-mail at [email protected].

Your Responsibility Under GDPR

If You are a UpRival User, then that probably means You are a business owner, using the UpRival platform to advertise goods and services to/or for your customers. With respect to the customer data that You provide to UpRival, UpRival is a data processor and will comply with its obligations under the GDPR; but with respect to Your customers, You are probably a data controller, and if any of Your customers is a citizen or a resident of a country in the European Union, then You must ensure that You comply with Your obligations as a data controller under the GDPR; namely, You must ensure that You afford Your Customers the rights identified in section (a) above. UpRival sells software; it does not provide legal advice or legal services, nor does it sell a “done-for-you” GDPR compliance package. Please consult legal counsel of Your own choosing for advice on what You need to do to comply with GDPR.
